Federal Supreme Court of the Republic of Iraq

AUTHORITIES

The Federal Supreme Court shall have jurisdiction over the following:

  1. Overseeing the constitutionality of laws and regulations in effect.
  2. Interpreting the provisions of the Constitution.
  3. Settling matters that arise from the application of the federal laws, decisions, regulations, instructions, and procedures issued by the federal authority. The law shall guarantee the right of direct appeal to the Court to the Council of Ministers, those concerned individuals, and others.
  4. Settling disputes that arise between the federal government and the governments of the regions and governorates, municipalities, and local administrations.
  5. Settling disputes that arise between the governments of the regions and governments of the governorates.
  6. Settling accusations directed against the President, the Prime Minister, and the Ministers, and this shall be regulated by law.
  7. Ratifying the final results of the general elections for membership in the Council of Representatives.
  8. A. Settling competency disputes between the federal judiciary and the judicial institutions of the regions and governorates that are not organized in a region. ; B. Settling competency disputes between judicial institutions of the regions or governorates that are not organized in a region.

COMPOSITIONS OF THE COURT

The General Secretariat

The General Secretariat is headed by a Secretary General with the rank of Deputy Minister who holds at least a university degree in law and has at least (10) ten years of experience, who is linked to the President of the Court and implements his directives.

Functions

  1. Registration of cases and referrals received by the court and completion of the procedures for notifications therein.

  2. The administrative or financial powers vested in him by the President of the Court.

Department of Administrative, Financial, and Legal Affairs

The Department of Administrative, Financial, and Legal Affairs is headed by a Director General who holds at least an initial university degree, the experience of not less than (10) ten years of experience, is linked to the Secretariat Division of the Director General, and exercises his administrative duties through the following departments:

  • Department of Lawsuits and Legal Affairs

Tasks:

  1. Registration and follow-up cases and requests received by the court.

  2. Making and following up on notifications.

  3. Writing the minutes of the court sessions and minutes.

  4. Representing the court in cases filed by it or against it, and participating in committees that require a legal representative.

  5. Send court decisions to the three authorities of the state.

  6. Provide the parties to the claims and applicants with copies of their court decisions.

  7. Send the court’s decisions to the Iraqi Gazette for publication.

  8. Send copies of the Court’s decisions to the Information Technology and Media Department for publication on the Court’s websites.

  9. Printing decisions and judgements issued by the court, proofreading them linguistically, and translating them.

  10. Attestation of pledges, guarantees, contracts, and organizing of financial disclosures.

  11. Participate in disciplinary investigation committees, and save and follow up in the implementation of the decisions issued therein.

Tasks:

  1. Managing personnel affairs, organizing staff, and conducting appointment and retirement transactions.

  2. Archiving and preservation.

  3. Determine the court’s need for human resources and develop the efficiency of its employees.

  4. Supervising the maintenance of buildings, vehicles, and furniture.

  5. Cleaning and service

  • Compensate those injured as a result of military operations and military mistakes

Department of Management of the Office of the President of the Court

The Department of Management of the Office of the President of the Court undertakes the following tasks, headed by an employee who holds an initial university degree and has experience of not less than (5) five years. 

  • Organizing secretarial and official mail work and keeping the necessary records for this.

  • Organizing secret mail.

  • Submit studies on the topics recommended by the President of the Court.

  • Execute the orders and directives of the President of the Court.

The department shall exercise its duties through the following divisions and offices:

  • Secretarial and Protocol Division

  • Office of Judges’ Affairs

  • Studies

 

AUDIT SECTION

The Audit Section undertakes the following tasks and is linked to the President of the Court:

  1. Audit financial and accounting transactions before and after disbursement.

  2. Audit financial records, statements, registration documents, and inventory of wareCouncils as required by the internal monitory system.

  3. Follow up on the reports of the Federal Financial Audit Office, identify its observations and causes, and review the answers received thereto.

  4. Submit supervisory reports to the President of the Court in cases that require it.

The department exercises its duties through the following divisions:
